ELECTRONIC WAIVER ACKNOWLEDGEMENT
By using Fewll Indoor Golf’s facilities (also refereed to as "studio", or "golf studio"), you acknowledge and agree to the terms in our Terms of Use, and Release and Waiver of Liability and Indemnity, which include your assumption of risks, liability release, and indemnity obligations.
Booking and Waiver Acknowledgement
When booking a session, all users (Members and Non-Members) will be required to electronically sign the Waiver before confirming their booking. This ensures you have read and agreed to the facility’s most up to date rules and liability release.
Waiver Agreement
By completing your booking, you confirm your agreement to the Release and Waiver of Liability and Indemnity as outlined in the Terms of Use. If you do not agree, you will not be able to complete your booking. You can view the Waiver here.
TERMS OF USE
These Terms of Use (“Terms”) govern your access to and use of Fewll Indoor Golf Inc.’s (“Fewll Indoor Golf,” “we,” “our,” or “us”) facilities and services, including any memberships, bookings, and communications related to our services. By using the Facility, booking sessions, or becoming a member, you agree to abide by these Terms. Please read these Terms carefully.
For clarity, the following terms are defined as they apply to this document:
Member: A person with an active membership plan with Fewll Indoor Golf. Members are granted access to the facility as per their membership level and are responsible for ensuring that they and their guests comply with all facility rules and regulations.
Guest: An individual who is invited by a Member, or non-member to use the facility. Guests must be accompanied by the booking party at all times and are subject to all rules and policies outlined in this document. Guests are limited to the number allowed by the Member’s membership plan.
Non-Member: An individual who books a session directly through the facility without an active membership. Non-Members are allowed limited access during their booking hours and must adhere to the same rules and regulations as Members.
FACILITY ACCESS AND USE
General Conduct
Users of Fewll Indoor Golf facility must behave in a manner that is respectful to others and the property. Disruptive, inappropriate, or unsafe behaviour will not be tolerated and may result in removal from the facility. Fewll Indoor Golf reserves the right to terminate memberships for valid reasons, including but not limited to breaches of facility rules, disrespectful conduct, or endangering the safety of others or the facility.
Health and Fitness Disclaimer
By using the facility, you acknowledge that golf and other activities offered may involve physical exertion. You are solely responsible for ensuring that you are in good health to participate in these activities. If you have any pre-existing medical conditions or concerns that may affect your ability to use the facility, you should consult with a healthcare professional before engaging in any activities. Fewll Indoor Golf does not provide medical advice or supervision.
No On-Site Staff and Personal Safety
Please be aware that Fewll Indoor Golf operates as a 24-hour facility without any on-site staff. It is your responsibility to ensure your own safety and that of your guests while using the facility. Users must carry their mobile phones for emergency contact and access. Additionally, please exercise caution when entering and exiting the facility—ensure that doors are securely locked when entering or exiting, and do not allow unauthorized individuals to enter. Members are not permitted to share their access passes with others. All guests must be accompanied by the member, at all times while on the premises. Power for mobile charging is available on-site.
Equipment and Facility Care Policy
A cleaning station is provided to clean both clubs and golf balls. Only clean golf balls and clubs are permitted to be used in the facility, using unclean gear may damage our screens. For safety and cleanliness, only clean, dry indoor shoes are to be worn in the facility. Shoe spikes are forbidden to avoid damage to the flooring and equipment. Any permanent damage to the screens or equipment cause by a members, non-members, or their guests will be charged to the customer who booked the tee time at the current replacement cost.
Swing Only Where You're Supposed To
All swinging must happen inside the tee box. Swinging clubs outside the booth? That’s a hard no. Be aware of your surroundings and check that your swing area is clear.
Intentional, or Preventable Damage
Any damage to the simulator or equipment, or general areas of the facility will be charged to the customer for the current replacement cost. However, Fewll Indoor Golf Inc., reserves the right to recover all costs associated physical, and/or reputational damages through legal actions against all parties involved. Security cameras are in place to ensure golfer safety and to protect our facility.
Outside Food and Beverage
Players have access to our 24-hour vending machines, or you can order outside food and non-alcoholic beverages—menus from local restaurants we’ve partnered with are available in the clubhouse. Please be respectful of the types of food you bring into the facility. We ask that you bring appropriate, non-messy foods that are considerate of other guests and the facility.
Tee Time is Snack-Free Time
Food and drink are strictly prohibited in the tee box. Enjoy your meals in the seating area behind your simulator or the clubhouse.
Substance-Free Swing Zone
In accordance with local bylaws and AGLC regulations for recreational facilities, alcohol, drugs, smoking, and vaping are prohibited.
Age Requirements
Parents and/or guardians must be actively engaged with their children. If minors (under 18 years) are using the facility, a parent or legal guardian must remain present within the facility at all times, and they are responsible for ensuring that the minor follows all rules and behaves appropriately. Children aged 5 and under are not permitted in the facility.
Keep It Tidy
Respect yourself and other players. Clean up after your session. This is a 24-hour facility, and nobody wants to wade through your leftovers. If you arrive to a booking that has been left untidy by the previous user please notify us via our contact form, include the time and date.
Respect Others’ Tee Times
Be on time for your booking and leave promptly when your session concludes. Your booking starts and ends at the scheduled time, warm ups and game play fall within your scheduled time. You can check the online booking tool and extend your time provided space is available and you have not exceed the max time slot allowable for your booking.
Photography and Filming
Photography and video recording are not permitted in the facility, except for personal use. If you wish to take photos or videos for commercial purposes or other uses, you must obtain prior written consent from Fewll Indoor Golf. Respect the privacy of other guests, do not film other members, non-members or their guests without their expressed permission.
Promotions and Discounts
All promotional offers and discounts are subject to availability and may have specific terms and conditions. Discounts cannot be combined with other offers, and Fewll Indoor Golf reserves the right to modify or cancel any promotional offers at any time.
No Tolerance for Discrimination or Harassment
We are committed to providing a welcoming and inclusive environment. Any form of discrimination, harassment, or inappropriate behaviour, whether verbal, physical, or sexual, will not be tolerated. Fewll Indoor Golf reserves the right to take immediate action, including notifying law enforcement or pursuing legal measures, if necessary. Future criminal or civil actions may also be initiated in response to severe or unlawful conduct.
Guest Policy
Guests may accompany members to the facility but must adhere to the same rules and regulations as members. Members are not allowed to bring more guests than their selected membership allows and the max is 4 people per-booking. Members must remain present with their guests at all times while in the facility.
Non-Member Conduct
Non-Members using Fewll Indoor Golf must adhere to the same standards of behaviour as Members. Disruptive, inappropriate, or unsafe behaviour will not be tolerated and may result in immediate removal from the facility. Non-Members must be at least 18 years of age to book sessions at the facility. Non-Members are responsible for ensuring that any guests accompanying them also follow all facility rules and regulations. Failure to supervise guests or address their inappropriate behaviour may result in immediate removal of both the Non-Member and their guests, as well as restrictions on future bookings.

Acceptance of Terms
By accessing and using the Fewll Indoor Golf website, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you must refrain from using the website.
Content Ownership and Restrictions
All content on the website, including text, images, graphics, logos, and videos, is the property of Fewll Indoor Golf or its content suppliers and is protected by copyright laws. You may not modify, reproduce, or distribute any content without prior written consent from Fewll Indoor Golf.
User Conduct
You agree not to engage in any activity that could damage, disable, or impair the website or interfere with other users' access and enjoyment of the website. You are prohibited from uploading harmful content, including viruses, malware, or other disruptive code.
Account Registration
Some services on the website may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities under your account.

While we take reasonable precautions to protect the website and your data, no method of transmission over the internet or electronic storage is 100% secure. You are responsible for protecting your own data and account credentials.

MOBILE AND EMAIL COMMUNICATION
By providing my contact information, I acknowledge and consent to receiving booking reminders, updates, and other relevant communications from Fewll Indoor Golf Inc. via email and/or mobile communication. These notifications are intended to ensure smooth scheduling and enhance my experience at the Facility. I understand that standard message and data rates may apply for mobile communications based on my carrier's terms. Fewll Indoor Golf Inc. will not share or sell my contact information to third parties and will use it solely for purposes related to my membership and Facility use. I understand that I can manage my communication preferences through the provided contact methods, but opting out of these notifications may affect my ability to receive important updates regarding my bookings.
In addition, I may voluntarily sign up for Fewll Indoor Golf Inc.'s newsletter to receive exclusive offers, facility news, and special event updates. I understand that I can unsubscribe from the newsletter at any time by clicking the "unsubscribe" link included at the bottom of any email communication.
MEMBERSHIP TERMS
Membership Terms & Limitations
The details, benefits, and limitations of each membership are outlined on our Membership Page and may vary by membership tier. Membership hours are provided on a monthly basis, and unused hours do not carry over into future billing cycles or accumulate. Memberships and all associated benefits are non-transferable. Members must be present for all bookings and may not lend, sell, loan, gift, or otherwise transfer their membership or membership hours. Additional simulator time may be purchased at the applicable member rate.
Cancellation Policy
Members may cancel their memberships online through their personal account at any time. Cancellations must be made at least five (5) business days before the next billing date to avoid being charged for the next billing cycle. There are no fees for cancelling. Membership access remains active through the end of the current billing cycle. Cancellations are not prorated, and no refunds will be issued for any remaining portion of the billing period. If you experience any issues cancelling online, please contact us for assistance.
Billing and Payment
Memberships are billed monthly on the same date the membership was activated. If the billing date falls on a holiday or weekend, the charge may be processed on the next business day. Payments must be made online by credit card or debit/credit card. All memberships automatically renew unless cancelled in accordance with the Cancellation Policy. Members are responsible for any NSF (Non-Sufficient Funds) fees or other fees charged as a result of a declined or returned payment.
Booking Cancellation Policy
Members may cancel or modify bookings up to twelve (12) hours before the scheduled start time. When a booking is cancelled within this time frame, the hours used for the booking will be credited back to the member’s account. Cancellations made less than twelve (12) hours before the scheduled start time, as well as no-shows, will result in the hours being forfeited.
Guest Policy
Members are responsible for the conduct and behaviour of their guests while at the Facility. Members and their guests must follow all Clubhouse Rules, and violations may result in the suspension or cancellation of the member’s account. Guest privileges and applicable fees vary by membership tier. Apex Club members may bring up to three (3) guests at no additional guest fee. Members must be present for all bookings, and no group may exceed four (4) people per booking.
Children aged 5 and under are not permitted in the Facility. Bringing unauthorized guests or exceeding the maximum group size may result in cancellation of the booking, suspension of booking privileges, or revocation of membership.
Changes to Membership Terms
Fewll Indoor Golf Inc. reserves the right to update or modify membership terms at any time. Members will be notified of significant changes via email or posted notices on our website. Continued use of the membership after changes have been communicated constitutes acceptance of the revised terms.
Membership Upgrades or Changes
Members may upgrade or downgrade their membership tier at any time without additional fees. Changes to membership tiers will take effect at the start of the next billing cycle.
Studio Pass Terms
Studio Passes are one-time purchases that provide a prepaid block of simulator hours. Pass holders may use their available hours at any time, with 24/7 access and no peak-hour restrictions. Pass hours never expire and may be used across multiple bookings. Studio Passes are non-transferable and must be used by the purchaser. Standard guest rates apply to guests accompanying Studio Pass holders. Pass holders must be present for all bookings, and no group may exceed four (4) people per booking.
Studio Pass holders must cancel bookings at least twelve (12) hours before the scheduled start time to have the hours credited back to their account. Cancellations made less than twelve (12) hours before the scheduled start time, as well as no-shows, will result in the booked hours being forfeited.
Bookings can be made through the online booking scheduler. Access is granted 15 minutes before the scheduled tee-off time.
Waiver of Liability
It is the member’s responsibility to ensure that all guests are informed of and agree to the Facility Release and Waiver of Liability and Indemnity. Members must electronically acknowledge the waiver at the time of each booking. By doing so, the member affirms that they have notified their guests of the waiver requirements and assumes responsibility for the actions, conduct, and safety of their guests while on the premises. Notice to all visitors is also posted at entry to the facility.
NON-MEMBERSHIP TERMS
Non-members are individuals without a current membership or pass who book individual/group playing time through the online booking scheduler. Non-members may book up to 7 days in advance. Bookings cancelled at least 12 hours before tee-off receive a full refund; later cancellations are non-refundable. All bookings and cancellations must be made online.
Non-members must follow the Clubhouse Rules and complete the required electronic waiver at the time of booking, which applies to the purchaser and their guests. Up to 3 guests are permitted, with a maximum of 4 people per booking. Access is granted 15 minutes before tee-off.
COACHING AND EVENT BOOKING GUIDELINES
Our facility is designed for personal and recreational use only. Members and non-members are not permitted to book sessions for the purpose of coaching others for profit, whether professionally or otherwise. Golf coaches or any individual offering coaching services may contact us directly to inquire about indemnity requirements and current openings.

Additionally, events at our facility must be booked directly with us to ensure availability and compliance with all regulations and requirements. This includes ensuring that all necessary resources such as: time slots, equipment, and space, are properly allocated and in a manner that prioritizes our members.
We also require that events comply with our policies, including but not limited to noise regulations, safety protocols, licensing, and liability considerations. By booking directly with us, event organizers can be assured of receiving the full support needed to host their event, including guidance on logistics, facility usage, and compliance with all necessary rules and regulations.

COMPETITION & TOURNAMENT POLICY
Eligibility for Prizes
To participate in our competitions, participants must be over the age of 18. Minors must have parental or guardian involvement to participate, due to complexities related to Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), which governs the collection of personal data from individuals under the age of majority.
Prizes are awarded only to participants who meet all eligibility requirements as outlined in the challenge rules and terms of use. Employees of Fewll Indoor Golf are not eligible to participate.
Verification of Submissions
Participants are required to provide proof of their performance to validate their submission. Fewll Golf reserves the right to request additional documentation or information as needed to confirm eligibility. Any submission that cannot be verified will be disqualified.
Tiebreakers
In the event of a tie, both participants will be declared winners and will each receive the designated prize for their placement. However, we encourage all participants to aim for their personal best and continue pushing for improvement.
Prize Distribution and Substitution
Winners will be notified via the contact information provided at the time of entry. Prizes must be claimed within 30 days of notification unless other arrangements have been made. Prizes hold no cash value, cannot be exchanged for cash, and are non-transferable. Fewll Indoor Golf reserves the right to substitute any prize with another of equal or greater value if necessary. Unclaimed prizes will be retained by Fewll Indoor Golf or awarded at its discretion.
Technical Failures
Fewll Indoor Golf is not responsible for technical malfunctions, simulator errors, or other issues that may affect submissions or the competition. If a technical issue arises, participants are encouraged to report it immediately to facility staff for resolution. In the event of widespread technical difficulties, Fewll Indoor Golf reserves the right to modify the challenge timeline or requirements.
Disqualification
Fewll Indoor Golf reserves the right to disqualify any participant found to have violated the rules or terms of use. This includes, but is not limited to, cheating, misrepresentation, or tampering with equipment. Cheating is defined as submitting altered photos/videos, falsifying scores, or engaging in behaviour that compromises the integrity of the competition.
Dispute Resolution
By participating, all participants agree that the announced decision by Fewll Indoor Golf is final and binding. Fewll Indoor Golf is released from any legal challenges or liability related to prize decisions. Participants who disagree with these terms are advised not to compete.
Publicity and Use of Name
By accepting a prize, winners grant Fewll Indoor Golf the right to use their name, likeness, and any submitted materials for promotional purposes without additional compensation, unless prohibited by law.
Modifications to Challenges
Fewll Indoor Golf reserves the right to modify or cancel challenges due to unforeseen circumstances, including but not limited to facility closures, equipment issues, or safety concerns. Participants will be notified of significant changes via email or the official website.
Liability Disclaimer
Fewll Indoor Golf is not responsible for any technical malfunctions, delays, or other issues that may affect the submission or awarding process. Prizes are offered "as is," without warranty or guarantee.
Policy Changes
Fewll Indoor Golf reserves the right to modify or terminate this Prize Winnings Policy at any time. Participants will be notified of significant changes through updates to the Terms of Use.
FRAUD AWARENESS AND PROTECTION
Fraudulent behaviour, including account impersonation and the replication of websites, is not limited to Fewll Indoor Golf and is a widespread issue affecting businesses and individuals globally. At Fewll Indoor Golf, we prioritize the safety and security of our participants, both in our physical location and online. Unfortunately, fraudulent individuals may create fake social media accounts or replicate entire websites to impersonate our business, attempting to steal personal information or deceive participants into engaging in unauthorized activities.
How to Protect Yourself
To protect yourself, only follow the social media links on our official website to ensure you are engaging with our verified profiles. Our website address is www.fewllindoorgolf.com. Be aware that some fraudulent actors may replicate full websites, profiles, or even promotions in an attempt to trick you. Always verify through the official channels listed on our website. Fraudulent accounts may have misspelled names, extra symbols, or suspicious activity such as excessive follow/unfollow behaviour. These accounts may also attempt to contact you directly through unsolicited messages, asking for personal details or financial information.
What We Will Never Do
Fewll Indoor Golf will never request payment or personal details via direct messages, announce competition winners through unofficial accounts, or ask you to click suspicious links or download files. Fewll Indoor Golf is not liable for any actions taken by fraudulent actors. If you encounter any suspicious accounts or believe you’ve been targeted by a scam, please report the account directly to the social media platform, local authorities and notify us at support@fewllindoorgolf.com. RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
By entering Fewll Indoor Golf Inc. (“the Facility”), I agree to this Release and Waiver of Liability and Indemnity Agreement. This agreement applies to all uses of the Facility, including parking lots, entrances, buildings, simulator bays, walkways, and any equipment or activities provided by the Facility.
In this Agreement, “RELEASEES” refers to Fewll Indoor Golf Inc., its affiliates, directors, officers, employees, agents, contractors, representatives, sponsors, successors, and assigns. “USER” and "I" and "Guest" refers to any individual entering, using, or engaging with the Facility and its equipment or services, including any guests or participants accompanying the User. “Golfing” refers to all activities undertaken in the Facility, including training, recreational play, or socializing. “Facilities” includes all areas managed by Fewll Indoor Golf Inc., while “Equipment” refers to all tools, devices, and gear available for use within the Facility.
I acknowledge that my use of the Facility and Equipment involves various risks, including but not limited to slips and falls, being hit by stray golf balls or clubs, injury from physical exertion, or exposure to infectious diseases. These risks may arise from my own actions or the negligence of others. By entering the Facility, I freely accept and assume all risks on my behalf and for anyone I permit to enter or use the Facility and Equipment.
In consideration of the RELEASEES permitting my use of the Facility and Equipment, I agree to waive any and all claims against the RELEASEES for any injury, illness, or death that may occur due to my use of the Facility, regardless of the cause, including negligence. I also agree to hold harmless and indemnify the RELEASEES against any claims arising from my actions or those of individuals I allow to enter the Facility. The RELEASEES’ total liability is limited to the amounts I have paid for using the Facility and Equipment, and they will not be liable for any punitive or consequential damages. This Agreement is binding upon my heirs, successors, and representatives.
I further agree that this Agreement is governed by the laws of Alberta, Canada, and any disputes related to it must be resolved through mediation or arbitration in the Province of Alberta before pursuing litigation.
I acknowledge that the risks of using the Facility may also arise from unforeseen circumstances, including weather conditions (e.g., slips or falls due to rain, snow, or ice), hazardous facility conditions (e.g., wet floors or slippery walkways), and accidents caused by the actions or negligence of other participants. I am fully responsible for any injury, loss, or damage I may suffer due to these or other unforeseen circumstances.
As a participant, I acknowledge that I am in good health and capable of participating in the activities at the Facility. I will not participate if I feel unwell or if any condition affects my safety or the safety of others. Children aged five and under are not permitted in the Facility, and children under the age of 18 must be actively supervised by a parent or legal guardian at all times. I will ensure that any minors I bring are supervised appropriately.
Fewll Indoor Golf Inc. is not licensed to serve alcohol, and no alcohol may be brought onto the premises. I understand that I will not operate any equipment while impaired. If I am attending a private or promotional event, I acknowledge that the booking party may obtain a liquor license, and I will follow the Facility's instructions in this regard.
I understand that in the event of an emergency, I must call 911 for immediate assistance, as no staff are present to provide assistance. I further acknowledge that the Facility is not liable for lost, stolen or any damage to personal property or equipment brought onto the premises by the User or their guests. I agree to follow all instructions provided by the RELEASEES and understand that failure to comply may result in removal from the Facility.
Fewll Indoor Golf Inc. reserves the right to modify rules and policies without prior notice, refuse service to individuals posing safety risks or failing to comply with rules, conduct surveillance for security and safety purposes, and take disciplinary action for any rule violations, including expulsion without refund. The Facility also reserves the right to adjust operating hours, cancel or reschedule bookings in cases of emergency, or implement emergency protocols as necessary.
By signing, I acknowledge that I have had the opportunity to ask questions regarding this Agreement, and my questions have been answered to my satisfaction. I am responsible for my actions and the actions of any guests I bring to the Facility. This waiver is irrevocable and remains in effect for all subsequent uses of the Facility. I understand and agree that I cannot revoke or withdraw my consent once this waiver is signed. I consent to the use of electronic signatures, which I understand are legally binding.
